Seated or not, Justice Brown can't render an opinion on this matter because by her own admission she is not a biologist, and she can't define what a woman is.
That was her answer to a direct question.

How can one tackle such a huge issue as abortion without even understanding the basics of human biology?
Or was she lying during her confirmation hearings, and she CAN actually define what a woman is?

Rhetorical question Jim but I'm sure you know that  :)

The statement she made was 100% for "Progressive" consumption but it points at the core of her judical philosphy will be based upon.

Okay, maybe so, but is she observing the court process beforehand? I've seen many times these high profile positions observe for a period of time before actually taking the seat. Not sure on SC but it wouldn't surprise me. Mainly so the judge doesn't get thrown into the middle of a case without full knowledge.

Yes, I realize that.
My point is that we should not let her slide on the content of that statement, regardless of her reasons for making it. 

If she can, in fact, define what a woman is, then she lied to Congress during her confirmation hearings.
If she cannot, in fact, define what a woman is, then she is not qualified to render an opinion on an abortion case.

I know I am over simplifying it, but she can't have it both ways.

She wasn't even a chosen replacement when the hearing on this case happened, the draft was written before she was nominated...

She hasn't even chosen her staff yet...so there's no staff to get anything to her...I doubt she was sent anything as the info appears to be out of date according to Roberts.

I'm just asking questions. I get how politics are played and one side can claim she wasn't on the court yet, however she COULD have been observing the cases beforehand. Like I said, it wouldnt surprise me if that was standard procedure.

Even the sanctity of closed door discussion among the members of the highest court is now a political weapon that is brought to bear for purely political reasons.

Now the fear is that Justices will hesitate to speak freely among themselves when discussing and debating the merits of a particular case, knowing their preliminary opinions may be leaked through the same channels as this one was.

Yeah sure, Roberts is going to conduct an investigation, but the damage is already done, and the integrity of the court is permanently compromised IMO.

Or just like Trump was being spied on while he was in the White House I suspect the justices are spied on as well. The ones doing it are left leaning and they released it knowing full well what it meant and let their ideology get in the way of the law like what has been happening for way to long with our political system on both sides. This just happens to be the one they crossed the line on. Anyone supporting the protest of this before the official ruling is saying they don't care about law they care about what they want plain and simple. They want mob rule to be the law of the land. BLM, Proudboys and ANTIFA and other organizations on both sides that think mob rule is the law of the land is wrong plain and simple.

Has anyone with a D next to their name come out and make a coherent argument against Justice Alito's opinion? Or has it all just been a bunch of emotional outcry at this point?

I'm more of a pro-choice person, but I don't see much of an argument against this opinion.  :shrug: 
I'll go back to being a conservative, when conservatives go back to being conservative.

It was leaked to coincide with the Indiana and Ohio primaries which were yesterday.
The Dems know they will get destroyed in the midterms so they are trying anything to stir up more hatred for the R's.
That and they needed a distraction.And the former VP thinks he's the 1st ever Senator from Delaware.
WTF? Get this feeble old man into the retirement home already! He doesn't even know what planet he's on!
