Not as bad as the topic title sounds.

I've never put much thought in to this as I haven't known any immediate family since I was about 16.

I getting to that age where I probably need to start thinking about making a will and getting things in order JIK.

Has anyone ever used nola.com to make a will?  Or would it be smarter to go through an attorney?  Are there other things that need to be done other than making a will?

The last thing I want is for the State to get anything extra from me.
I'll go back to being a conservative, when conservatives go back to being conservative.

A friend of mine is a Paralegal, and he recommends LegalZoom for most people.

Unless you have tons of assets, lots of real estate, or you own your own business, a simple will that is tailored for your state laws is usually good, and costs less than $100.

Now of course I do expect a small cut for the free legal advice... :harhar:

After dealing with my dad's estate...there is a lot more to end of life planning than most people think or actually do....It is best to distribute your possessions or wealth before your life ends if possible. This way you know your wishes are fully carried out (eliminate the fighting afterwards).

I don't imagine that there is going to be a lot of fighting over my assets. My immediate family, and this is going to sound oxymoronic, couldn't afford to inherit anything I own. They would have to get rid of it and I don't think that they would be able to do that without a lot of help.

Can the executor be the same person everything gets left to?

I may have to look in to this. Even with the legal advise, the cost is only $250.  :htu:

I am in Canada and yes the executor can inherit as well.

if things are simple doing it yourself has big cost advantage. we down loaded ours some where off Clark Howards web site. customized to our liking then took it to an estate lawer ($100/hr). he reviewed and gave us the nod. not a yes this is air tight cause he wanted us to pay him thousand plus to do it his way.
careful each state is different in needing witness and or notary.
also living will and power of attorny can get a little sketchy if you are not careful.
if you have a person you really trust it is wise to put all in there hands. it helps them have all the tools needed to follow through.

I witnessed this first hand with my divorced mom and dad. dad had attorny do his and spread responsabilitied accross three kids. it was a fucking mess.
my mom gave me full control of every thing and went very smooth. she got to witness the dad mess and chose me after i told her i dont care wich of the three she picked but I was unwilling to split responsability cross board. every thing was split 3 ways to the penny.

Yes, this is often the case with married couples where the surviving spouse is the executor, and also the main beneficiary.  You can basically leave all of your assets to whomever you like, and that same person can also be named the executor of your estate.

Again, if your estate is not complicated, like with business partnerships or lots of assets and / or real estate holdings, LegalZoom can draw up a basic will that will take care of everything without spending a fortune.

It's definitely not that complicated.  I own a condo that is soon to be paid off. A couple of vehicles that aren't worth much. Then just whatever is in the Condo.

The only thing I could see that may be complicated due to potential greedy family members is the 401k and bank savings.
