Thomas' test leads to heinous results given that the "ancestors" in question were often violently racist and misogynistic white men. As the 5th Circuit tacitly acknowledged, "our ancestors" would "never have accepted" disarming domestic abusers because they did not believe domestic violence was a crime.

Domestic Violence STILL isn't a crime in dozens countries on earth. I'm not saying that is right, I'm saying that in a historical context (which matters in trials), is is NOT inconceivable to believe that was once the case here in the US.

Sadly, the charge of "Domestic Violence" has become SO watered down today, that it has unfortunately become nearly meaningless to judge the severity of any particular case.

Case in point; you and your significant other get into a heated argument, you "PLACE" your open hand on their shoulder... a touch... much the same way you would offer comfort to someone in pain, you ARE guilty of Domestic Violence and you're going to be arrested. 100% guaranteed. AND you're losing your constitutional rights. AND you WILL be forced to surrender your firearms to law enforcement before the trial where the likelihood of getting them back regardless of trial outcome hover somewhere between slim and none. If there's a witness, GUARANTEED you ARE going away for a while, not just for an overnight stay in the Gray Bar Motel. This isn't a hypothetical situation, it is a situation that plays out hundreds if not  thousands of times a year all across the US.

So, should that individual loose their Constitutional Rights in that scenario? For Life? I don't think so. There is absolutely NO compelling reason for matters of personal OR public safety to deny that type of individual their Constitutional Right to keep and bear arms. But since that DV tag is slapped on the charge/conviction they are gone.

Here in WI James it's the person who calls in first to report the abuse. Doesn't matter who did what it's an instant 24 hr hold on the other party.

Me too.
Got lucky that the accuser was a nitwit, but at the same time unlucky that totally imagined some crap. LEO sent the case to the DA. Amazingly, that's where it ended. That almost never happens.
