CNN loses another defamation case

CNN found liable

QuoteA Florida jury found CNN liable on Friday in a high-stakes defamation trial against U.S. Navy veteran Zachary Young, who alleged that the network maligned him as an "illegal profiteer" with a report on Afghan evacuees being charged thousands of dollars to flee the country following the U.S. military withdrawal.

Following two days of deliberations, the jury ruled that CNN must pay Young $4 million in financial damages and $1 million for emotional damage, adding that Young is also owed punitive damages. The trial is now heading into a second phase to determine the amount of punitive damages Young should receive from the network.

Gotta wonder how CNN decided to take this one to trial instead of settling. Easy for me to Monday morning quarterback, but I did call it in another thread

there was a lot of damning evidence in that case. CNN really should have known better. But the one that got me was from Jake Tapper's deposition, he was asked about his "on Air" statement that Fox news is a cancer on society for their willful lies about Dominion Voting.

They asked him, "If a news organization lies purposefully about a "non-election" story is that still a danger to democracy?"

His answer was essentially, "You're asking me to comport with a metaphor that I used a year ago specifically about one specific news — or purported news — organization. And the opinion I had about how damaging those lies were to the American democracy. And you're asking me to take that metaphor and extend it to any other time that any other media organization that lied willingly,"  "I don't have an opionion on that"

The news is really in a doom loop. Each channel being pressured by their own viewership to make one of the political parties look bad. If they tell the whole truth, they lose viewers. If they tell the partial truth they maintain status quo and if they lie or exaggerate, they gain short term viewers but lose lawsuits and money.

It's actually pretty hard to win a defamation case because "intent" is part of the calculus as well as proving damages. Did they intend to spread a lie they KNEW was a lie or were they "just" acting on bad outside information? Proving what someone "knows" is a REALLY hard thing. There's more to it, but I won't bore you with the minutiae.

The media gets WIDE latitude with regard to lying. They know this and they almost never have to answer for it. Even the National Enquirer... they don't have to pay out very often. The odds are in the media's favor to take it to court. Against a public figure/organization? The burden to prove defamation is even harder.

1. He is wasn't a public figure
2. They had emails outlining how they did him dirty.
3. He could show monetary damages

Just getting to trial is huge, that's where the should have settled, according to my daytime dramas in TV
