This will get complicated. I don't see how any court can go against the 14th amendment. It's not like a law passed in Congress that the SC can say is unconstitutional. They would be saying the 14th amendment is unconstitutional. It is my understanding that the only way to change an amendment to the constitution is to make an entirely different amendment. I'm for interpreting it as always .

My Problem is the abuse of it. >:(

Not The natural application of it.

It was intended under a completely different circumstance.

Unfortunately it's far more sinister than that. These "birthing houses" have been around since the early-mid  90's. NOTHING was done. We've let more than enough CCP babies be born here to fill EVERY elected seat in Kommieforniastan AND DC Combined. These are ALL eligible to be POTUS. The 1st wave are just about 35 now.

And if people don't think the CCP are grooming some commie scum to be POTUS, they are morons.

It HAS to end.

It has been long going. It's origin is called the Kalergi Plan (after Richard Kalergi) and has turned into the UN Migrant Pact.

We've got plenty of homegrown Democrat plants in the Republican party, shouldn't be so hard to imagine CCP planting US politics more robustly.
Seriously folks, if you could see a day at the L.A. Federal building's passport office, it's like the DMV busyness but 95% Chinese nationals (and their newborns) multiplied by 24/7/365.
Yeah maybe trying to do this through the executive branch seems sketchy on the legal front, but we are literally being taken over from the inside and Congress will never act until after the horse leaves the stable. Better to have a true leader at the bully pulpit.
MAGA!

While I abhor the EO method, I honestly cannot think of another way to get it to the courts. While I believe the courts will continue the status quo, It opens the door to future legislation and/or a Constitutional Amendment.

By the time that happens, it will be too late. I think right now it's too late, but we have to at least try.

What is going on with these anchor babies is not eeeeeeeeven in the realm of what the founding fathers had in mind. The purpose of the Amendment is crystal clear. It was not created to shield illegal immigrants offspring, or to infiltrate our form government. Which is how it is being used.

Stephen A Smith, as much as I dislike him as a sports guy and even in general, he hits the nail on the head here on Maher's show.
He feels like a fool for voting for Kamalalala.

I think he always has some good points in a discussion. I like him more now than earlier in his career.

I guess points for admitting it but come on...
Just sounds stupid, like Ben Shapiro voting for Killary.

Yes, INTERPRETING it is the key, and is also the job of the Supreme Court.
Nobody is suggesting the 14th Amendment be changed in any way.

The result of Trump's Executive Order in this case will most likely FORCE the Court to do their job and interpret the exact meaning of the 'citizenship clause' as it applies to ILLEGAL immigrants.

IFFFFFFFFFFFFFFFF the Court decides that 'and subject to the jurisdiction thereof' does NOT apply to people who crossed the border illegally, then the Executive Order would be ruled unconstitutional and rescinded.

Either way, we will finally have a clear ruling.

Problem is you have a few hundred years worth of immigrants, both legal and illegal. Are they going to go back a few generations, find out that someones great grandparents entered illegally....and kick them to wherever grandma and grandpa came from?

Not reasonable.

And because of that, its not like they can say, "OK, from this point forward...."

In my way of thinking they would have to do this with a whole new amendment, saying "from this point forward"

I agree. Too many people will be living in fear of being deported with their children. My personal view is get the bad ones out and make a path for citizenship to at least those who have been here for years.

That is a fair and reasonable position.
Too bad there is so much fear-mongering in the media that is making everyone think Trump wants to send Grandma back to Mexico or South America next week.

He said very clearly that the PRIORITY is to identify and deport the criminal element within the illegal immigrant population FIRST.
That alone could take several years.

Having said that, at some point there MAY be further deportations, but realistically just getting the worst offenders rounded up and shipped out will be a win for the country.
