In many cases, Congress has all but abdicated their role. The War Powers act most immediately comes to mind but there are other cases in where they let SCOTUS decide law.

Yep.
Another huge problem.

The founders designed a brilliantly simple, workable form of government with three separate but equal branches, and with checks and balances between all of them.
The only possible flaws could happen when the checks and balances were removed, and one or more branches then either abdicates or oversteps its authority.
In our current state, Congress has definitely abdicated its authority in many respects, and the Judicial and Executive branches have both overstepped theirs by leaps and bounds.  
Presidents governing by Executive Order, and the Supreme Court crafting law from the bench are absolutely NOT what the founders envisioned, and are in fact the kinds of things they most wanted to avoid.
