Should the government be allowed to track everyone at all times?

But as John Yoo points out the beauty of the US government is that, when you get power hungry people in all 3 branches of government their hunger to keep power from the other 2 branches of government actually is what provides the checks and balances necessary.

Is that why the president customarily rules by executive order these days?  And the ATF and other unelected agencies create legislation via "interpretations"?
