In the State of California If he got his staffer drunk to the point of blacking out that is Rape with intoxication (Penal Code 261(a)(3)). It's a felony. IOW, drunk sex is not consensual sex. That crime carries with it an 8 year stay in the Gray Bar Hotel.

Worth noting, it's not limited to situations where the person being accused intentionally intoxicated the alleged victim. It applies even if the person became intoxicated willingly. The critical factor is whether the intoxication rendered the alleged victim incapable of giving informed, free, and voluntary consent to the sexual act. You can still potentially be charged with rape simply because the other person had too much to drink, and you chose to have sex with them anyway.

California law outlines that consent is affirmative action. Thus, you cannot claim that the victim consented because she did not resist.

Further, for consent to be present, two people must have agreed to engage in sexual intercourse. The legal age of consent is 18 years. The law says that both parties must be of sound mind when agreeing to engage in sexual intercourse.

When did California Dem's ever care about abused women?
This is raw politics, nothing more.
 
California has a jungle primary, meaning the top two candidates  in the primary move to the general election regardless of party affiliation.

The California Dem's gleefully fast tracked the jungle primary ballot proposition back in 2010 thinking they would freeze Republican's out of state elections forever. In many cases it has worked, but it this case it may come back to bite them.

The top 2 in the primary pols are currently Republican and if the primary for governor was held today, there would be 2 Republicans on the ballot for the general election.

Swalwell's abusive behavior has been common knowledge for years and Dem party leadership has never blinked an eye.
Swalwell is currently #3 in the polls behind two Republicans. This new found outrage is nothing more than a means to
force him off the ballot because they know his rapey behavior may not sit so well with the general public.

There will be calls for more Dems to drop out "for the good of the party" and possibly more scandals will come to light as well.

As an ex-Californian, I'm kind of enjoying the show, though I doubt the Republicans will prevail.

It's NEVER too late in The People's Republik of Kommieforniastan to elect compromised Democrats.

I think the ONLY thing that keeps Swallowswell from being nominated is if he's literally  incarcerated. Even then... it is The PRK.
