Quote from: neurosis on July 01, 2024, 12:27 PMI'm more concerned with how this decision can be abused moving forward. And not just by Trump.

The reality is all this decision does is to affirm that a President, acting in accordance with the enumerated powers of his office cannot be criminally charged. There is a Constitutionally defined process to remove that person from power if they abuse their powers.

If a President acts outside of those enumerated powers, and it is believed to be illegal, he can be criminally charged.

That is how it should be.

Truly is that black & white despite all of the colors of gray the talking heads are trying to paint.

Focus on the enumerated powers because that's where the rubber meets the road in this one

IMO, this is just the SCOTUS looking out for big gov abuses. A week ago they said it was ok for gov to collude with big tech to censor speech they don't like. This ruling just goes along with the SCOTUS big gov totalitarian leaning opinions.

Yes, and it must have killed you when Rush Limbaugh passed away.
I'll go back to being a conservative, when conservatives go back to being conservative.

Who??

Never watched or listened to him or Tucker.

I don't even listen to Fox anymore. Sean can't STFU.

I prefer to think for myself.

But I do get a Belt out of you.

I mean, the SCOTUS did just gut a key federal bribery statute recently.

The judges Trump appointed have been conservative on social issues, but have sided with big gov power every time it has been presented.

QuoteThe ruling came a day after the court in another 6-3 decision on ideological lines had weakened the power of the Securities and Exchange Commission, prompting an equally vigorous dissent from liberal Justice Sonia Sotomayor.
QuoteThe fear among those on the left is that the Chevron ruling will handcuff agencies from tackling major issues like climate change because judges will constantly second-guess their expertise.

Whether the ruling will have such a broad impact remains to be seen, with some commentators saying that in most cases judges will still give close attention to what agency experts say.

Are these the same "experts" like at the ATF ... the agency tasked with enforcing firearms laws that cannot even rack the slide on a common semi-automatic handgun? Those "experts"?

I have a better idea you affirmative action hire, FORCE congress to do their jobs... you know, the one we hired them to do and you do yours; interpret the laws they write in light of the Constitution? How about we do that?

QuoteOne criticism of the latest ruling — echoed by liberal Justice Elena Kagan in her dissenting opinion — is that the court is seizing power for itself from federal agencies.

No you shit for brains affirmative action hire, the merely ruling FORCES Congress to do it's fuckin' job. Congress... ELECTED politicians make laws and regulations... so when they fuck up we can fire them for it... unlike those worthless mouth breathing shitbird bureaucrats at the Alphabet soup. I swear, Obama and Biden's justices are complete and total imbeciles.

Clearly you do not understand Chevron deference. Having been a firearms owner for decades, alphabet soup has been pointing THAT gun at us since inception. Making up rules and regulations that were NEVER supposed to be part of their jobs, but since when has that stopped them.

The abomination that was Chevron deference is the big gov abuse. SCOTUS killing it was a win for making congress do their fuckin' job instead of forcing agencies and the idiots they hire that are accountable to no one and judges legislating from the bench doing it.

Yeah, but writing and passing legislation that works for the good of society and is constitutional is like, hard, man.

Especially when your primary job as a congress critter is running for re-election.

Yup.
Can't let those pesky Constitutional thingys get in the way of a good reelection campaign.
