I don't know why that's an argument.  It comes across as a lazy attempt to dismiss what happened. There was plenty of proof that people went there with the intent of preventing the certification of the election. People were calling for the hanging of Pence at the protest for christ sake.

The right to peacefully assemble to redress grievances is guaranteed by the U.S. Constitution.

By the way, the only person who was shot was an Air Force veteran named Ashley Babbit, who as a petite 35 year-old UNARMED woman was apparently enough of a threat for a Capitol Police officer to use deadly force, so let's not go too deep down the rabbit hole of what WE think anyone's 'intent' was on that day.

And YES, the insurrection charges, or lack thereof ARE a big deal.
The media trotted out that word and started throwing it around within minutes of the PROTEST, but what those people did never rose to the level of an actual insurrection.

Yet when cities burned during the BLM and ANTIFA riots where multiple people did lose their lives, and millions of dollars worth of property damage was done, the same media insisted those were 'peaceful protests'.
