The one question that the Supreme Court hasn't answered yet, is whether the right of citizenship extends to parents that are here illegally. In Wong Kim Ark, the chinese parents were legal citizens. I suppose that it's worth asking the SC to decide on that. My gut feeling is that if Scalia were still alive and on the bench he would take the plain wording of the text and say that it does extend to illegal aliens. And then he would probably repeat his oft used line, the constitution is what it is, but if you don't like it, get together with some of your neighbors and convince you representatives to write a law.
