When do governments attack the judiciary?

This is an ongoing research article.

I thought it seemed fitting for the time. :shrug: Too bad they don't extend the deadline out a few years.

When do governments attack the judiciary? The explanatory power of political corruption

  • As political corruption increases, ruling governments become more likely to verbally attack the judiciary.
  • In countries with independent media, higher levels of corruption correlate with higher government attacks on the judiciary.
  • In countries with non-independent media, political corruption does not lead to government attacks on the judiciary.
  • In countries with partially independent media, government attacks on judiciary increases as corruption increases.

Is it too much to point out that there are judges that are involving themselves in things in which they have NO Constitutional role....

That said, higher courts will eventually correct those issues.

The large question though, why shouldn't those judges be criticised?

Unfortunately, this research paper doesn't include the US. I wish it did and I wish it included presidencies from the 90's through the current.

There have been something like 120+ lawsuits filed against the Trump admin in three months.  Which judges are overstepping their constitutional role? Are we deciding that some are overstepping based on personal opinion?

If a judge believes that Trump is breaking Federal law or over stepping his constitutional power, isn't it their job to act on it?

They should if that's what they're doing. They're being criticized before and not just being attacked verbally by the current admin, but threatened.

Some of you guys are a lot smarter than I am on this. A couple in particular. Over all I feel like there hasn't been a lot of consistency in opinions across administrations.

Overstepping constitutional roles seems to be a common practice in our government nowadays.

For that matter, so is understepping their constitutional roles by one body in particular.

There should always be some amount of tension between the executive, legislative and judicial branches if you want a system of checks and balances. if they work in complete lock-step with each other, then you have a dictator ship.
