I never said she didn't hit him. I said she was not intentionally trying run him over, making the shooting unjustified.

In the NYT video they point out that his feet slipped on the icy street, he lost his footing on the slippery road as she started driving toward him, inhibiting his ability to get out of the way, she hit him in the rib cage, because he was leaning forward as feet slipped. roughly the 4:00 mark

btw that's not my analysis, that is the NYT.

Her intent is the most important part. Her actions were not those of someone trying to kill an ICE agent.
As I said, it may be legal but it was not necessary nor morally justifiable. Now, we've each stated our sides many times and doing it many more times won't change either of our minds.

I don't think she really hit hm, if anything it looks like brushed by him. If it even did make contact with him, how fast could she have possibly been going? Nothing about that was life threatening.

In my view the telling action is when the ICE agent took his third shot at her through the open driver's side window. The car was beside the man. The only way that the woman could have injured him at that point would have been to stop driving and attempt to hit him by opening the door. Not much threat anymore.

But.... an old neighbour in spain told me the time he was late to the doctors, on his motorbike turned into a road and there was a queue of 30 cars stationary as it was a police stop.
So he turned around, rode back up the road to go another way, and within 2 minutes had 2 police bikes by his side stopping him.
They made him turn around and go back to the queue and by the time he got to the front they waved him through without stopping him anyway :hrhr:

While I see the logic that you are following here. The flaw in it is that an officer doesn't have time in the moment to consider intent.

He had time to walk in front of the car and switch his cell phone in to the other hand, so his firearm hand was open. :shrug:
