IMO, this will be the ultimate test to see if Kavanaugh and Barrett are conservatives that believe in freedom or if they are McConnell big gov, globalist RINOs. If I had to bet now knowing how they have been so far, I'd say the mandate stands. Which will further empower the Biden admin to do more power grabs.

Interesting article about previous Supreme court cases around mandated vaccines. After reading this article I am even more of the belief the SCOTUS will side with the Biden admin. They may even turn the case down and reference the 1905 case with a claim that they don't need to hear it because it has already been ruled on.

IMO, the scariest part about Biden's speech and mandate yesterday was the tone. Biden doesn't write his speeches, heck he can barely deliver them. They are written, reviewed, re-written, etc. by a team. The words are chosen carefully and purposefully. His speech was very devisive.

Those are words that divide and pit people against each other. I am starting to think everything they are doing is aimed to create massive civil unrest so they can use it to take a giant step towards true totalitarian control.

The 1905 case was based on a law passed by the Massachusetts state legislature, not an EO signed by the president. Like Biden's CDC issuing a rent payment moratorium, this will get bitch slapped back in face.

BMI is often a bullshit standard. A great many VERY in shape athletic types are considered "obese" by this standard.

I get it.

There are plenty of guys on college and pro football roosters that the BMI calls obese. A few more can be seen at your local gym.

But the VAST majority of the people that the BMI indicates are obese are fat as hell.

I have never propped up BMI as an absolute standard. BMI doesn't account for muscle, bone density, bone structure, etc. I am 5' 11" and run about 170-175. I normally walk around at about 18% body fat and when I am preparing for a comp I probably get down to 15% or even less. If I put on 5 more lbs of muscle, at 180 lbs my BMI would put me just inside the overweight rating. The truth is though, for most people that don't exercise regularly, especially strength conditioning, the BMI is probably an accurate assessment of body composition.

I sure hope you are right, but so far it seems Barret and Kavanaugh are far more big gov than conservative in their rulings.

So from what I understand they are trying to enforce this through OSHA Act of 1970 as an "Emergency Temporary Standard"

Section 6(c)
Quote(1)

The Secretary shall provide, without regard to the requirements of chapter 5, title 5, Unites States Code, for an emergency temporary standard to take immediate effect upon publication in the Federal Register if he determines --
(A)

that employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards, and
(B)

that such emergency standard is necessary to protect employees from such danger.
(2)

Such standard shall be effective until superseded by a standard promulgated in accordance with the procedures prescribed in paragraph (3) of this subsection.
(3)

Upon publication of such standard in the Federal Register the Secretary shall commence a proceeding in accordance with section 6 (b) of this Act, and the standard as published shall also serve as a proposed rule for the proceeding. The Secretary shall promulgate a standard under this paragraph no later than six months after publication of the emergency standard as provided in paragraph (2) of this subsection.


Has anyone else heard this - what are your thoughts on if it will stand?
