So from what I understand they are trying to enforce this through OSHA Act of 1970 as an "Emergency Temporary Standard"

Section 6(c)

(1)

The Secretary shall provide, without regard to the requirements of chapter 5, title 5, Unites States Code, for an emergency temporary standard to take immediate effect upon publication in the Federal Register if he determines --
(A)

that employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards, and
(B)

that such emergency standard is necessary to protect employees from such danger.
(2)

Such standard shall be effective until superseded by a standard promulgated in accordance with the procedures prescribed in paragraph (3) of this subsection.
(3)

Upon publication of such standard in the Federal Register the Secretary shall commence a proceeding in accordance with section 6 (b) of this Act, and the standard as published shall also serve as a proposed rule for the proceeding. The Secretary shall promulgate a standard under this paragraph no later than six months after publication of the emergency standard as provided in paragraph (2) of this subsection.

Has anyone else heard this - what are your thoughts on if it will stand?

I saw an opinion piece that said because they are trying to go around the legislative process and push this through OSHA as a work around it is likely the reason it will not stand in court.

The fact that the USPS is exempt shows prejudice against everyone else. This also crosses the line into the Tenth Amendment. Every State has the right to protect their citizens as the Legislative and Executive leaders sees fit. If they are making the attempt use OSHA as the hammer then that's even more fodder to the opposition since the leadership was not elected into office.

My opinion is they want to go the OSHA route and not the Legislative route is because this situation just might be severe enough to have electoral consequences which none of those scum want to face.

So, going this route gives the majority idiot public the illusion that Congress is doing "something". Congress can then ultimately blame whatever boogeyman they want should by some miracle the judicial branch pull it's head out of it's ass and fail that unconstitutional crap.

Fraudcci is such a piece of garbage. Probably almost killed him to say that natural immunity is worth talking about. And to think a large percentage of people in this country respect his opinions.

We don't give to polio vaccine to people that have had polio. There's at least a half dozen vaccines we don't give to people if they've had the actual disease. Every reason those frauds have given for taking their not-a-vax even if you've had THE REAL DEAL is complete bs and not grounded in anything that remotely looks like science.

If you need to because your ACTUAL doctor, not some lying piece of garbage fraud like Faucci on TV recommends it, by all means, please do what you gotta do for you and your situation. That is a personal decision to be made that is between you and your doctor, not you and your employer, and especially not you and your government. We can't even trust those pieces of crap to not arm terrorists.

BMI is often a bullshit standard. A great many VERY in shape athletic types are considered "obese" by this standard.

A week ago the cluster F in Afghanistan was consuming the news cycle. Even prominent Dems were starting to turn on Biden. This last weekend being the 20th anniversary of 9/11 was sure to make him look even worse when we remembered why we were there in the first place. If you take out retired people and kids under 12 from the equation, then remove people that work at companies smaller than 100 employees and those that are exempt (postal workers, etc). This mandate really only affects a small portion of Americans. I am wondering how much of this mandate was just for the purpose of changing the news cycle. Biden is hemorrhaging support and approval. The Dems know that historically with popularity numbers like Biden has it will mean a massive loss in the midterms. The need to put Afghanistan behind them and it is easier to get people to forget an outrage if you give them a new one to focus on.

Had this discussion with a nutritionist I was seeing...she agrees it's mostly BS...

It's the same standard for males and females and doesn't take much into consideration...

That said, there's obviously a healthy weight for a person and an unhealthy weight..and the BMI index isn't even a good "ballpark"
