He put at least one woman in the hospital with broken bones in her face from an unprovoked beating.

Most accounts of his death fail to include the fact that a black man and a Hispanic man helped Penny
subdue the him.
They left before the police arrived, Penny stayed and spoke with the police.
They called him back to the station later for a 2nd interview without telling him the kid had died.

The deceased was someone with severe mental illness who was failed by both the mental health system and the justice system.  He was apparently randomly attacking people on the subway that day when Daniel Penny and another guy decided to do something to protect those passengers who couldn't protect themselves.

In my opinion, these kinds of cases are precisely why Good Samaritan laws exist.
These two guys took action to help other people who were being assaulted by an obviously deranged man, so I believe they are entitled to the benefit of the doubt.  :yes:

He has a GiveSendGo account which has raised $3.2 million but I'm sure his lawyer's bill was breathtaking
and he's facing a civil liability lawsuit.
I'd imagine between the two, they will chew through $3.2 million pretty quick.

Prosecutors have BROAD discretion when it comes to the charges they file.

Malicious prosecution is a HARD burden to prove. It's not impossible, but it's an uphill battle to say the least.

Eddie Gallagher... that was a case of malicious prosecution. I believe the prosecutor was disbarred.
